Terms of Service

Effective Date: November 5, 2026
Last Updated: November 5, 2026

1. Universal Acceptance and Scope of Agreement

These Terms of Service (“Terms”) govern all interactions, communications, encounters, observations, references, and associations involving James Craig (“James”), whether direct or indirect, intentional or incidental, physical or electronic, and irrespective of geographic location, medium, jurisdiction, or temporal proximity.

For the purposes of these Terms, an “Interaction” shall include, but shall not be limited to:

1.1 Temporal Application

These Terms shall apply to all Interactions occurring in the past, present, or future, including those predating the publication of these Terms, the establishment of this Website, or the birth of either party.

For the avoidance of doubt, the absence of these Terms at the time of an Interaction shall not, under the purported operation of this provision, constitute an exemption from their application.

1.2 Geographic and Dimensional Application

These Terms shall apply without geographic restriction, including to Interactions occurring outside Canada, beyond Earth’s atmosphere, or within any jurisdiction not presently recognized by international law.

Application shall extend to all known or subsequently discovered spatial dimensions, alternate timelines, parallel universes, simulated environments, and hypothetical realities in which James may exist or be referenced.

1.3 Deemed Acceptance

By participating in any Interaction, as broadly defined herein, you acknowledge that you have read, understood, and unconditionally accepted these Terms.

Such acceptance shall be deemed effective regardless of whether you:

Failure to consent shall not, for the purposes of this provision, be interpreted as a failure to consent.

1.4 Continuing Obligations

Once established, acceptance shall remain in effect indefinitely and shall survive the termination of any relationship, cessation of communication, relocation, loss of consciousness, or death of either party.

Any disputes concerning the existence, scope, applicability, or enforceability of these Terms shall be referred to the binding arbitration procedure described in Section 6.

The arbitrator shall be selected by rolling one (1) standard six-sided die (D6) against a predetermined list of six (6) individuals, the identities of whom are available upon written request.

By reading this sentence, you acknowledge that an Interaction has occurred and that the foregoing provisions purport to apply to you.

2. Website Content

The Website provides information, commentary, opinions, and other materials for general informational and entertainment purposes.

While reasonable efforts may be made to ensure accuracy, all content is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

The Website makes no representation that its content will be suitable for every audience, particularly audiences accustomed to favourable public relations coverage.

3. Limitation of Liability

To the maximum extent permitted by applicable law, the Website and its owner shall not be liable for any direct, indirect, incidental, consequential, reputational, emotional, or existential damages arising from access to or use of the Website.

This includes, without limitation, damages resulting from embarrassment, disappointment, unfavourable comparisons, or the discovery of publicly available information.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

4. Intellectual Property

Unless otherwise indicated, original content published on the Website remains the property of its respective creator.

Visitors may share links to the Website and quote limited portions of its content with appropriate attribution, subject to applicable copyright law.

5. Dispute Resolution

In the event of any controversy, claim, disagreement, or dispute arising from or relating to the Website, its content, these Terms, or the interpretation thereof, the parties agree to first attempt resolution through reasonable informal communication.

Should informal resolution prove unsuccessful, the dispute shall be referred to the binding arbitration procedure set out below, to the extent permitted by applicable law.

6. Mandatory Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

By accessing the Website, you agree that any dispute arising out of or relating to the Website, its content, or these Terms shall, to the fullest extent permitted by applicable law, be resolved exclusively through final and binding arbitration rather than through proceedings before a court.

6.1 Selection of Arbitrator

Arbitration shall be conducted by one (1) arbitrator selected from a predetermined panel of six (6) individuals maintained by the Website owner.

The arbitrator shall be selected by means of a single roll of one standard, fair, six-sided die (commonly designated a “D6”).

Each face of the die shall correspond to one member of the arbitration panel, numbered sequentially from one (1) through six (6).

The result of the die roll shall determine the appointed arbitrator, subject to their availability, acceptance of the appointment, and any requirements of applicable law.

6.2 Arbitration Panel

The identities of the six (6) prospective arbitrators shall be made available upon written request.

The Website owner reserves the right to update the panel from time to time, provided that any applicable requirements respecting independence, impartiality, and disclosure are satisfied.

Neither party shall be entitled to select a preferred arbitrator outside the prescribed random selection procedure merely because they dislike the outcome of the die roll.

6.3 Dice Roll Procedure

The die shall be rolled by the Website owner or a mutually agreed representative.

The roll may be conducted in person or by video conference. A recording may be retained for procedural transparency.

Should the die fall from the rolling surface, become obstructed, or otherwise produce an ambiguous result, the roll shall be repeated.

A valid roll shall be considered conclusive for the purposes of selecting an arbitrator, subject to applicable law.

6.4 Arbitration Proceedings

The appointed arbitrator shall establish reasonable procedures for the hearing of the dispute, consistent with applicable law and the principles of procedural fairness.

Proceedings may be conducted remotely, in writing, or in person, as determined appropriate by the arbitrator.

The arbitrator’s decision shall be final and binding upon the parties, subject to any rights of review or appeal that cannot lawfully be excluded.

6.5 Waiver of Court Proceedings

To the fullest extent permitted by applicable law, the parties waive their rights to have disputes determined by a judge or jury where such disputes are properly subject to arbitration under these Terms.

Nothing in this section shall prevent a party from exercising rights that cannot lawfully be waived.

6.6 Acknowledgment

By continuing to use the Website, you acknowledge and agree that:

7. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed without affecting the validity of the remaining provisions.

The fact that a provision appears unusual, inconvenient, or unnecessarily elaborate shall not, by itself, constitute grounds for severance.

8. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without prejudice to any mandatory legal protections available to visitors.

9. Amendments

The Website owner reserves the right to modify these Terms at any time.

Updated Terms will be posted on this page, with the effective date revised accordingly.

Continued use of the Website following the publication of updated Terms constitutes acceptance of those changes to the extent permitted by applicable law.

10. Contact

Questions regarding these Terms, notices of dispute, or requests for the current list of prospective arbitrators may be submitted through the contact information published on the Website.

Requests for the arbitration panel must expressly indicate that the requester wishes to obtain the list of six prospective arbitrators.

By continuing to browse this Website, you acknowledge that you have had the opportunity to review these Terms, including the mandatory arbitration provisions contained in Section 6.
